1. Agreement and Parties

This Terms of Service Agreement ("Agreement") is between OKASER ("Company", "we", "us", "our") and you ("Customer", "you", "your"), the individual or entity purchasing or using our hosting services available at host.okaser.net.

By completing registration, submitting payment, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by this Agreement.

2. Services

OKASER Hosting provides web hosting services, including but not limited to:

• Shared web hosting (Starter, Pro, Business plans)
• Email hosting
• MySQL databases
• SSL certificate provisioning
• Control panel (Virtualmin) access
• DNS management

Service features and limits are as described on our pricing page at the time of purchase. We reserve the right to modify service offerings with reasonable notice.

3. Account Registration

You must provide accurate, complete, and current information when creating an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use at destek@okaser.net

You must be at least 18 years old to purchase our services.

4. Payment Terms

All services are billed on a monthly basis. Prices are displayed in your local currency equivalent at checkout.

• Payment is due at the beginning of each billing cycle
• We accept major credit and debit cards via Square secure payment processing
• Invoices are sent to your registered email address
• Failure to pay within 7 days of the due date may result in service suspension
• Accounts suspended for non-payment for more than 30 days may be terminated and data deleted

5. Refund Policy

The following are excluded from the refund policy:

• Renewals after the initial billing period
• Accounts terminated for violations of this Agreement
• Domain registrations (if applicable)
• Any add-on services purchased separately

6. Acceptable Use Policy

You agree to use our services only for lawful purposes. The following activities are strictly prohibited:

• Hosting, distributing, or transmitting illegal content of any kind
• Sending unsolicited bulk email (spam) or operating spam services
• Hosting malware, viruses, phishing pages, or any malicious code
• Copyright infringement or violation of intellectual property rights
• Running cryptocurrency mining operations
• Conducting denial-of-service (DoS/DDoS) attacks
• Unauthorized access to other systems or networks (hacking)
• Hosting adult content without appropriate age-verification systems
• Violating any applicable local, national, or international law or regulation

We reserve the right to suspend or terminate accounts found in violation of this policy immediately and without prior notice.

7. Service Level Agreement (SLA)

OKASER Hosting commits to a 99.9% monthly uptime guarantee for all hosting services.

Scheduled maintenance windows are excluded from uptime calculations and will be announced at least 24 hours in advance where possible.

In the event of uptime falling below 99.9% in any calendar month due to causes within our control, you may request a prorated credit applied to your next billing cycle.

8. Data, Backups, and Security

While we take reasonable precautions to protect your data, you acknowledge that:

• You are ultimately responsible for maintaining your own backups of all data
• OKASER Hosting performs periodic server backups on a best-effort basis; these are not guaranteed
• We are not liable for data loss resulting from hardware failure, software errors, or any other cause

We implement industry-standard security measures including SSL/TLS encryption, firewalls, and intrusion detection systems.

9. Intellectual Property

You retain full ownership of all content you upload to our servers. By using our services, you grant OKASER a limited, non-exclusive license to host, copy, and serve your content solely for the purpose of providing the services.

OKASER's brand, logo, website design, and all related intellectual property remain the exclusive property of OKASER.

10. Privacy

Your use of our services is also governed by our Privacy Policy, which is incorporated into this Agreement by reference.

11. Limitation of Liability

To the maximum extent permitted by applicable law, OKASER Hosting shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, revenue, data, or business opportunities
• Damages resulting from unauthorized access to or alteration of your data
• Any damages exceeding the total amount paid by you in the three (3) months preceding the claim

12. Indemnification

You agree to indemnify, defend, and hold harmless OKASER and its officers, directors, employees, and agents from any claims, damages, losses, costs, or expenses arising out of or relating to your use of the services or your violation of this Agreement.

13. Termination

Either party may terminate this Agreement at any time:

• By you: Cancel your account through your control panel or by contacting support. No refund will be issued for unused time unless within the 30-day refund window.
• By us: We may suspend or terminate your account for violation of this Agreement, non-payment, or for any reason with 30 days' written notice.

Upon termination, all data associated with your account may be permanently deleted after 30 days.

14. Changes to This Agreement

We reserve the right to modify these Terms at any time. We will notify registered customers of material changes via email at least 14 days before the changes take effect.

15. Governing Law and Disputes

This Agreement shall be governed by and construed in accordance with applicable law. Any disputes shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration.
